Draft Planning Agreement: Pitt Street Mall, Sydney NSW 2000

The City of Sydney proposes to enter into a Planning Agreement relating to the Development Application D/2007/1228.

Location: 184-190 Pitt Street, 168-174 Pitt Street, 77-83A Castlereagh Street, 97-99 Castlereagh Street, Sydney 2000

The objective, nature and effect of the draft Planning Agreement is to secure the performance of upgrade works to Pitt Street Mall as a whole, with the works occurring in stages which have regard to surrounding redevelopment. 

The work is intended to include the area immediately adjoining the development site (referred to as Section B in the draft Agreement); the Northern area (referred to as section C) and a section of the Pitt Street Mall which adjoins the Mid City Centre (referred to as Area A).

The value of the upgrade works to Pitt Street Mall as a whole (estimated at approximately $10 million) is reasonably anticipated to exceed the developer’s contribution under s.61 of the City of Sydney Act, being an amount of approximately $4,938,172.13.   The Agreement is intended to apportion the responsibility for the overall costs, having regard to the conditions imposed in the consent to the DA.   

The proposed works promote the following objects of the Environmental Planning and Assessment Act 1979:

5(a)(i)  the proper management, development and conservation of natural and artificial resources….for the purposes of promoting the social and economic welfare of the community and a better environment.

5(a)(ii)  the promotion and co-ordination of the orderly and economic use and development of land

 5(a)(iiii) the protection, provision and do-ordination of communication and utility services

Pitt Street Mall is to be upgraded in conjunction with the redevelopment of the adjoining properties, allowing a positive long – term outcome.     

 The draft Agreement promotes the following elements of the Council’s Charter as set out in section 8 of the Local Government Act 1993:

(a) to provide………..adequate, equitable and appropriate services and facilities for the community and to ensure that those services and facilities are managed efficiently and effectively.

 (b) to properly manage, develop, protect, restore, enhance and conserve the environment of the area for which it is responsible, in a manner that is consistent with and promotes the principles of ecologically sustainable development

 (c)  to have regard to the long term and cumulative effects of its decisions

 (d)  to bear in mind that it is the custodian and trustee of public assets and to effectively account for and manage the assets for which it is responsible

The development by Westfield has an important relationship with Pitt Street Mall, and this has been responsibly recognised by Westfield through its agreement to undertake the upgrade of that civic space.

 The proposed Agreement is consistent with the City’s 2009 Capital Works Program, and supported by the Sustainable Sydney 2030 Strategy.
