Terms and conditions: Australian Life 2021

By submitting an entry into this competition artists accept the following terms and conditions:

  1. Artist remuneration and judges prize
    1. The competition and exhibition are free to the public. If your entry (artwork) is selected to be included in the exhibition, you will be paid a fee of AUD$500 plus GST (if applicable) upon receipt of a valid tax invoice or submission of a statement by supplier form if you are not registered for GST and do not have an ABN number. The form will be provided to finalists who require it. 
    2. If your entry is judged the most outstanding by the panel of judges, you will be awarded the “Australian Life Prize” and receive AUD $10,000 cash. The winner will be paid on receipt of a valid tax invoice or submission of a statement by supplier form if you are not registered for GST and do not have an ABN number.
    3. If the winner does not redeem the prize within 6 months, then the prize will be forfeited by the winner, and there will be no further unclaimed prize determinations. To be clear, this means that there will not be a further selection of a winner by the panel of judges if the prize is forfeited by the winner.
  2. Terms and conditions of the Australian Life exhibition
    1. You must submit your entry to the City by 11.59pm on 25 May 2021.
    2. Your entry must:
      1. meet the specifications outlined on the entry form
      2. include a completed online entry form.
    3. The City will publish selected entries online on September 16, 2021.
    4. The City will exhibit the selected artworks in Hyde Park from 16 September 2021 to 10 October 2021.
    5. Inclusion of any photograph in the exhibition is subject to selection by the judging panel. The decision of the panel is final and no correspondence will be entered into.
    6. Finalists and the overall winner will be notified by phone and email by a representative of the City of Sydney.
  3. Peoples choice competition and prize
    1. From 9am, 17 September 2021 to 5pm, 5 October 2021 the entries will be part in a “People’s Choice” competition
    2. After viewing the finalist photos displayed at the Hyde Park exhibition or the online gallery, members of the public may go online and vote for their favourite entry.
    3. The entry that receives the most votes, by the end of the exhibition, will be deemed the People’s Choice and will be awarded a prize of photographic equipment (as selected by the City, at the City’s discretion) to the value of $AUD5,000
    4. In the event of a tie, each winner will receive a prize of photographic equipment (as selected by the City, at the City’s discretion) to the value of $AUD5,000. 
    5. People’s Choice votes are only open to residents of Australia and each person may only vote for one (1) entry.
  4. Copyright and moral rights
    1. You grant the City the right to:
      1. retain a digital copy of the artwork
      2. enlarge and adapt the artwork to fit the large scale format of the exhibition or online gallery.
      3. exhibit the reproduced artwork in Hyde Park from 16 September 2021 to 4 October 2021 as part of the exhibition.
      4. adapt the photo for use in City media or marketing campaigns.
    2. You warrant that you are the owner of all intellectual property rights in the artwork or have obtained all necessary approvals to permit the use of the artwork in the exhibition. Artwork that infringes intellectual property rights will be immediately removed from the exhibition. You agree to indemnify the City against any costs the City may incur as a result of any intellectual property rights infringement.
    3. The City and any sponsor or partner of the exhibition may reproduce the artwork (or any part of it) in any media format, including but not limited to advertisements, postcards, brochures, posters, television/print media, website and annual reports, including for the purposes of:
      1. publicity and promotion of the exhibition
      2. the catalogue of the exhibition
      3. creating a non-commercial archive of the exhibition.
    4. The City will acknowledge you in all exhibition publicity as the creator of the artwork.
    5. Applicants release the City from any claim with respect to infringement of moral rights related to their entry.
    6. While the City will take care to ensure the integrity and quality of the reproduced artwork, you acknowledge enlargements and slight variations to the artwork may result from adapting the original artwork to the large-scale format or the printing process.
    7. You acknowledge and agree that you will not be entitled to claim compensation for any damage to the original artwork while in the care of the City or the exhibition production team and contractors.
    8. You may be asked to sign a model release as a condition for inclusion of your artwork in the exhibition. Failure to provide this release may result in your artwork not being included in the exhibition.
  5. Large format reproduced artworks
    1. Large format reproduced artworks will remain the property of the City until 31 October 2021.
    2. The City will refer all sale enquiries about the large format reproduced artworks to the artist or gallery representative.
    3. Following Australian Life 2021, if not sold, lost or destroyed prior to 31 October 2021 the applicant may wish to organise and fund the collection of the large format reproduced artwork from a location to be specified by the City. 
  6. Sponsor exhibition
    1. If the City or an Australian Life sponsor or partner wishes to host a small scale exhibition of selected works, the artist agrees to their work being exhibited free of any charge or fee.
    2. All artists will be acknowledged by having their name, title of work and contact details listed on signage.
  7. General
    1. Participants may submit a maximum of 2 entries to the competition.
    2. Council Representatives and Employees of the City of Sydney and their immediate families are ineligible to enter the competition.
    3. You must complete the online entry form. By entering into this competition, participants acknowledge and accept these terms and conditions.
    4. The City may cancel or vary the exhibition at any time. The City will not be responsible for any loss or costs incurred by you in relation to such cancellation or variation.
    5. By entering the competition, you release the City from, and indemnify the City against all liability, loss, damage or injury arising from or in connection with this competition or prize.
  8. Privacy

    The personal details requested will only be used for the purpose of competition entry to Art & About Australian Life photography competition 2021. Access to the information is restricted to City of Sydney employees and other authorised personnel only. The supply of this information (is required is voluntary. If you are unwilling to provide this information, the City of Sydney may be unable to provide access to City of Sydney services. The Events and Festivals team at the City of Sydney, located at 456 Kent Street, Sydney NSW 2000, is collecting this information and the City of Sydney will store it securely.
