Terms and conditions: Art and About 2026 banner gallery expression of interest

By participating in the expression of interest process, participants acknowledge and accept the following terms and conditions.
Submissions
- Submissions must be submitted online by Thursday 31 March, 2026 at 11:59pm Sydney time.
- Submissions are at the artist’s own cost.
Shortlisting and selection
- The City reserves the right to select artworks in part or in full.
- All decisions made by the City in relation to the EOI process, including but not limited to the selection, adoption of designs and the development of the final banners are final.
- The selection of any artwork will be at the sole discretion of the City.
- Artwork must be submitted in accordance with the instructions specified by the City and its representatives from time to time.
- Failure to incorporate the City’s responses to submissions may lead to the artwork being no longer suitable for selection.
- The artist of the selected concepts will receive a 2-part payment: $2,000 plus GST paid to further develop the concept on submission of the original artwork images, $3,000 plus GST paid on submission of refined artwork images submitted by a date to be specified by the City. A valid tax invoice and the required bank details for payment must be provided prior to payment. No further payments will be made for a submission, irrespective of the number of artworks and artists it comprises.
- All designs will be subject to a rigorous assessment process to determine feasibility for development.
- The City reserves the right to not proceed with any artworks submitted during the EOI process, and/or to source artworks outside the EOI process. The City has a right to abandon final selected artworks in its absolute discretion at any stage including the final development stages for whatever reason.
- Shortlisting and/or acceptance of artworks may be subject to an interview process which may be face to face or by audio-visual link.
General
- Artists participating in the EOI process must comply with all directions given by the City in relation to the EOI process. Artworks selected through this EOI process will be presented as part of Art & About 2026.
- Artists selected by the City at the conclusion of the EOI process must enter into a simplified consultancy contract with the City for the delivery of the banner gallery. A copy of the contract that will apply will be provided to all artists as part of the EOI. The City will generally not enter into negotiations on the standard conditions of the contract.
- No legal or other obligations will arise between an artist and the City unless or until a simplified consultancy contract has been signed by both parties.
- The use of machine learning artificial intelligence platforms, known as generative AI, in the creation or development of artworks is not permitted.
- Both the City and the artist must agree on the way the artwork will be attributed in any launch or publication material for the purposes of any moral rights in the artwork.
- Artists must not make any statements to the media about the EOI process and/or the artwork/project without prior approval from the City. If artists or other personnel involved in the EOI process is contacted by the media, they must first contact the City before providing any response.
- Participating artists acknowledge and accept that the City may need to manipulate the design concept to suit the requirements of the banner gallery.
- Artists are responsible for obtaining public liability insurance (minimum of $10 million per occurrence) and workers compensation or personal accident insurance (if the artist is self-employed).
