Draft planning agreement

The City of Sydney proposes to enter into a deed of variation to the planning agreement relating to the development application:

DA Number: D/2015/154
VPA Number: VPA/2015/3
Location: 1 Metters Street, Erskineville NSW 2043

The objective of the Deed of Variation is to facilitate the completion and dedication of the public domain work prior to the occupation certificate for stage 2 (the terrace houses).

The nature of the deed of variation is to amend original planning agreement to include:

  • the staged occupation of the site, with stage 1 being the apartments and stage 2 the terrace houses
  • an easement and covenant for public access over the future roads and pedestrian link prior stage 1
  • the dedication and transfer of the roads and pedestrian link prior to stage 2
  • an environmental insurance policy on terms acceptable to the City for the roads and pedestrian link prior to stage 2; and
  • incorporation of the changes made in a previous deed of variation by consolidating and restating the planning agreement.
