City Use of User-Generated Content

The City may use, share or re-post images, photographs or video published on social media by other users on City social media channels (e.g. Instagram, Facebook, Twitter, Tik Tok) and City websites.

Permission

The City will always seek permission before using content by leaving a comment with a link to the Terms and Conditions, asking the user to agree by responding using the hashtag #cityofsydneyagree. 

The user’s comment on the content using that hashtag constitutes agreement to the Terms and Conditions. If permission is not received by return comment, the City will not use the content. 

Term and Conditions

These Terms and Conditions constitute a legally binding agreement between you and the Council of the City of Sydney, ABN 22 636 550 790, of 456 Kent Street, Sydney NSW Australia 2000 (‘City’), and is subject to the laws of New South Wales, Australia. 

By you responding with the hashtag #cityofsydneyagree to the City’s request to use one or more images, photographs, or videos (including audio) that you have published on social media (‘Content’), the parties agree to these Terms and Conditions.  

You:

  1. Confirm you are at least 18 years of age or have obtained the consent of your parent or guardian to agree to these Terms and Conditions. 
  2. Warrant that:
    a. you own the copyright in the Content or have sufficient rights to grant the licence to the City,
    b. the Content does not infringe the rights, including copyright, trade marks, or privacy, of any person, 
    c. the Content, and your creation and use of it, complies with all laws. 
  3. Grant the City a non-exclusive, worldwide, royalty-free, perpetual, revocable licence to use, copy, modify, adapt, publish, and communicate to the public the Content on City social media channels and websites. 
  4. Agree that, whilst the City will endeavour to credit you when using the Content, you will not hold the City liable for any act or omission that may constitute an infringement of your moral rights. 
  5. May revoke the licence granted to the City by emailing [email protected] 
  6. Acknowledge that the City:
    a. is under no obligation to use the Content, 
    b. may remove the Content from its social media channels and websites at any time without notice,
    c. is not, by its use of the Content, endorsing or supporting you.  
  7. Agree that:
    a. you will not receive any payment or other remuneration for the City’s use of the Content, 
    b. you will not make or bring any claim against the City for any reason in relation to the City’s use of the Content,
    c. to the extent permitted by law, the City is not liable for any damage, injury or loss suffered by you as a result of the City’s use of the Content. 
  8. Consent to the City collecting, using and disclosing your personal information, in the form of your name and social media username/handle, for the purposes of:
    a. attributing the Content to you on the City’s social media channels and websites,
    b. recording your agreement to these Terms and Conditions. 
  9. May request access to, or update, your personal information by emailing [email protected] 
    The City:
  10. Agrees:
    a. you (or the creator of the Content, if applicable) retain ownership of the copyright in the Content,
    b. it will only use the Content in accordance with the licence granted, and will contact you to seek any further rights if required by the City,  
    c. to credit you in each City use of the Content, where practicable, by mentioning your social media username/handle and/or name. 
  11. May choose to link to your website or business social media profile when using the Content, at the City’s sole discretion. 
  12. Will, in the event you revoke the licence granted to the City, remove all City uses of the Content within a reasonable timeframe. 
  13. Agrees to store your personal information securely, comply with applicable privacy laws and the City’s privacy management plan, and only use your personal information for the purpose for which it was collected. The supply of this information is voluntary and City employees are the intended recipients of this information.
