Terms and conditions

By participating in the Art & About Sydney 2026 expression of interest process, participants (‘artists’) acknowledge and accept the following terms and conditions.

Submissions

  1. Submissions must be submitted using the Art & About Sydney returnable documents by 5pm Sydney time on Wednesday 12 November 2025.
  2. Submissions must include all the information specified in the expression of interest process.
  3. All costs incurred by artists in any way associated with the preparation and submission of an expression of interest are entirely borne by the artist.
  4. The artist must disclose in the submission details of all proposed or required funding, partners, sponsors, presenting partnerships, producers (other than the City of Sydney) or similar third parties for the artist and/or the project.
  5. The artist must disclose in the submission details of any generative AI platform used in the planning development or presentation of the project.
  6. Failure to submit all information required as part of a submission, or failure to disclose the details set out in item 4 above, may result in the artist’s submission being excluded from evaluation or rejected from the expression of interest process at any time.

Information and enquiries

  1. Where an artist has any doubt about the meaning of any aspect of the expression of interest process, the artist must make enquiries in writing to [email protected] by Monday 20 October 2025.

Selection

  1. The City of Sydney (the City) reserves the right to select any number of submissions as part of the expression of interest process, including not selecting any submissions.
  2. The City reserves the right to select submissions in part or in full.
  3. All decisions made by the City in relation to the expression of interest process are final.
  4. The selection of any submission will be at the sole discretion of the City.
  5. The City reserves the right to reject submissions that the City deems (at its sole discretion) to be incomplete, not feasible, high risk, insufficiently detailed or undefined, do not comply with the specified submission requirements or terms and conditions, or do not meet the brief.
  6. The City reserves the right to not proceed with any submissions, and to source projects outside the expression of interest process.
  7. Acceptance of submissions may be subject to an interview or presentation process.
  8. The City reserves the right to consider projects for presentation dates beyond October 2026.

Artist not to solicit City personnel

  1. During the expression of interest process and until the City makes a final decision, artist’s or anyone involved in the submissions (including subcontractors) must not contact, talk to or try to talk to any City employee, councillor or anyone working with the City about the expression of interest or their submission. The City reserves the right to reject any submission that contravenes this condition.

Conflict of Interest

  1. Artists must disclose any conflict of interest in performing the commission or completing the work as part of their submission. This includes detailed information about the nature and scope of the conflict of interest and how the artist would resolve or manage the conflict of interest if selected.
  2. In these terms and conditions, conflict of interest means an actual or potential pecuniary or non-pecuniary conflict of interest. For more information, refer to the City’s code of conduct.
  3. If an artist fails to disclose a conflict of interest and the City then becomes aware of the conflict, the artist may be excluded from this expression of interest process. This includes any future process by which the City is seeking proposals for the provision of goods or services.

Agreement

  1. Artists selected by the City at the conclusion of the expression of interest process must enter into an Art & About commissioning agreement with the City for the completion of the work. A copy of the agreement will be provided to all artists as part of the expression of interest process. The City will generally not enter into negotiations on the standard conditions of the commissioning agreement. Any proposed amendments must be made as part of the expression of interest process in the returnable forms.
  2. No legal or other obligations will arise between an artist and the City unless or until an Art & About commissioning agreement has been signed by both parties.

General

  1. Works selected through this expression of interest process will be presented as part of Art & About Sydney, produced and commissioned by the City.
  2. Works selected through this expression of interest process must be presented from 23 to 25 October 2026, unless otherwise agreed by the City.
  3. Artists must have a valid Australian Business Number (ABN) to participate in the expression of interest process.
  4. Artists and participants in the expression of interest process must comply with all directions given by the City in relation to the expression of interest process.
  5. Artists must not make any statements to the media, or include any statements on social media, personal websites or other public forums, about the expression of interest process and/or the project without prior approval from the City.
  6. Artists will be responsible for obtaining public liability insurance (at least $20 million per occurrence), professional indemnity insurance (where relevant), and worker’s compensation insurance as required by law. Selected artists must provide the City with certificates of currency for all required insurances as part of the expression of interest response.
